It's passive. If Makima remotely has the feeling to it is.It depends if Conquest is only an ability she's able to activate if she sees herself as superior, or if Makima herself chooses not to Conquest someone depending if she sees herself as superior.

Yes, it's perception based, so if you somehow harm Makima without the intent to harm her, you can bypass the contract. But it's entirely situational. Denji had this mentality in the graveyard fight, and yet Makima's contract was still going strong. The main premise is that you're not really out to harm Makima at all. I didn't realize both characters were bloodlusted. In that case, I'll vote for Makima considering immediate conquest. I don't believe in those ice-man win cons regardless, i'd rather play skeptical until further context is given.Ice-Man FRA then.
