Being ranked as the same tier doesn't mean much since the highest part of each tier is 10 times more powerful that the lowest.

Besides, he didn't nearly kill akainu anyway. He was still looking for a fight even after that last devastating attack Whitebeard gave him. It's enough to say that he was stronger, but to put him in a higher tier would imply that old an sick whitebeard could potentially one shot Akainu.
