Base Shiki was still able to somewhat contend with False Overdrive Jinn, so its in the same tier and thus can't be restricted.

Kris was trying not to kill Shiki until he got pissed off. Base Shiki not even remotely scales to false overdrive Kris. Hell even false overdrive Shiki at the time doesn't scale.
Kris was going to kill Shiki in that exchange when he got actually serious if not for Drakken's intervention, Drakken confirmed this himself.

Kris dices Muller into pieces. Arsenal (who had a lower attack than even base Shiki) was able to slice apart Muller, so Kris would definitely able to do the same (like he did to the life support machine).

He's also likely faster, Kris was totally overwhelming Shiki in terms of speed even when he was in base.
