Takes place in Bowser's castle from Mario Kart wii.

Victory by KO, Death, or permanent death if Mario has any way of getting past Dave's immortality.

Dave can pretty much time travel to screw Mario over, no way Mario is trumping that level of hax. Dave will simply time travel and undo his mistake or hit him with an attack he can't avoid

Didn't Mario also have time travel? I'm pretty sure he displayed that ability at the end of Yoshi's new island.
