All I'm saying is Goku can one shot with anything he has. Can Ness mindhax? Maybe, if he can right away he should win with speed equal but if not Goku wins.

Of course I don't actually remember where Ness' mindhax comes from since I haven't played Earthbound since like 2006 so I can't say for certain who would win.

Goku is above universal yes but he's not universal+, the + signifies more than just being above universal here and the thing it signifies is above what Goku can do.

Not really? I mean, sure Ness can mindhax like EVERYONE ELSE KEEPS SAYING, but also remember that Goku can basically 1-shot Ness if he gets a hit on. If Ness does pretty much anything other than to prevent Goku from immediately unleashing an AoE super blast then I'm pretty sure he's dead.

Ness' durability is FAAAR higher than baseline, though not his AP. He can survive hits from a restrained Giygas.
