CASE: Animatronics Look like a fan game of Fnaf but not fan game.

Case is on Nintendo Switch. Nintendo only not allow fan game.
CASE is a special case as all it uses is animatronics, not licensed/owned characters.

Even though yes it is inspired by Teletubbies and Slender it possesses original lore and its own distinct canon. It also features original characters such as The Guardian, Ghost Girl and The Announcer. Yes things such as the Jeff the Killer Saga are based off something public domain, it STILL counts as fanfiction since it perfectly goes along with the google definition of Fanfiction and is widely considered to be fanfiction (And really, tell us how it isn't glorified fanfiction).

Because it has its own vastly different lore and it uses public domain characters. The other Jeff series created by the same guy is defiantly fanfic though, as it includes characters like Masky and Hoody, which are actual licensed characters, as well as including Five Nights At Freddy's stuff. Even though it gives both of those different lore, that man isn't Scott or the creator of Marble Hornets. So that is fanfic.

Just because it has its own vastly different lore shouldn't warrant that it isn't fanfiction. Going off that logic, Slendytubbies has its own vastly different lore from the source material, so it doesn't count as fanfiction then if we are thinking like that. The things you mention kinda are fanfiction, that type of stuff happens with Public Domain.

You are comparing licensed characters to public domain creations. If the new public domain creation has its own lore, it isn't considered fanfic. When a licensed character is repurposed without permission it is called stealing, and even if it is a free game or the creator of the new stuff says they don't own the original characters, it is considered a fangame aka fanfic.

So you admit that is fanfic. And no, I am saying in regards to public domain characters that is the case. Not licensed.
