Nobody aside from Tosen is shown to use or even know about Haien, him having it wouldn't affect the balance of souls at all, maybe if it was a technique that was taught to every Shinigami in the academy then you'd have an argument, but as it stands literally nothing goes against it being EE.

And there's no evidence Tosen even learned it at the Academy or that they even teach it there.

The point is central 46 will notice such dangerous Kido and ban it or smt along those line. They don't do that since we know it wasn't a forbidden kido.

It hasn't been stated to be forbidden sure, doesn't mean that isn't the case, our knowledge on it is extremely limited given that it was used by a single character only once and never brought up again.

Regardless, aside from theorising that it can't EE because Central 46 would have banned it (Not a very strong argument imo, but whatever), there's literally nothing contradicting it, we don't see anything remain after Tosen uses it on Grimmjow's arm.

Central 46 seems to ban only extreme kido like time stop, that teleportation tesai did and stuff that can legit destroy sereitei no matter if is kido or not (like some bankais they have restricted) but hado like the one Rosen used seem to be to target a specific target and not an AOE attack that could damage sereitei nor put the balance at risk

For all we know, Tosen literally could have made the Kidō himself, it's about as plausible as saying he didn't given that we have no knowledge on it beyond him using it once, we can theorize all sorts of things but at the end of the day, the only hard evidence is the statement from the databook and the fact that nothing remained of Grimmjow's arm.

i agree with everything except hado 54

Yama haven't use his bankai in like 1000 years, last time he use it vs Yhwach it was only incomplete version of it, only his base bankai (no EE)

i think we should at least clarify that with his fate manip his attacks are infinite in speed
cuz not all fate manip are infinite like this as seen with vanessa from black clover
and the example matthew gave for death note is different and cant be used imo as light would have to write the thing he wants to happen down and as explained in the series the way things happen should be possible and not unrealistic and this takes time and isnt an instant like yhwach
even the heart attack kill takes 40 seconds
so imo we should clarify

not in an instant like yhwach
yhwach does it through the future and takes 0 seconds
so whatever he does already took place without him needing to do anything in the present

I'll weigh a little here.

I definitely agree that Soi Fon's shikai should lose the poison manip. That explanation comes from the anime, not the manga, IIRC. I definitely agree that it's Death Manip but I wouldn't say that it's durability negging. She has to be able to create a wound/surface area to interact with to trigger the ability. If she can't actually inflict wounds (like if the target is too durable), then she can't do it.

the cat is still doing an action(touching the opponent) in the present and its teleportation could be done in a finite amount of time

it should be infinite
and i dont mean yhwach's speed is infinite he isnt
but he can make his attacks infinite by the allmighty as they dont take place in the present but he brings them from the future to the present time

3.Change the shikai of soi fon from poison manipulation to death hax

The ones that we have yet to talk and accept

1.sealing for oetsu
2. Resistance to spacetime hax and gravity for ichigo
3. Poison resistance for grimmjow
4. Resistance to power absorbsion and life manipulation for Uryu (and maybe ichigo)
5. This one is not on the OP but I think should be added which is that hollows are poisonous for those that dont have antibodies

I think it was necessary for soifon to penetrate/injure her target to activate its ability
If she only need to touch, her bankai will become obsolete against stronger opponents.
