It's not that he doesn't use it because he thinks it isn't necessary, it's that he's too arrogant. He won't use it unless he respects Gal

Even when Shirou was countering him in every way in UBW and was plunging down with a sword, he still hesistated to use it

It will go like this:

They meet, Talk a bit, Gil attacks him with Gate of Babylon, Gal stops the attacks in mid-air or his wards stop them. Gil uses high caliber phantasms that will still do nothing, Gal tries to mind rape Gil which does nothing.

In this case there is the question if Gals death spells can affect Gil (Spirit form or not ?). And the moment Gil realizes that his high callibers dont do anything he will use Emuma and kill Gal.

Servants do still have (normally) human biology, so death spells could work. Question of whether they get through the armour's magic resist

Spirit form isn't normally used in combat

There are plenty of weapons that can negate magic though, like Rule Breaker or Gae Dearg
