Most of the time, Black Hat does everything he does just for pleasure or because he is bored. But he only did EE because he was angry with Aku, so it can be said here that this is the first move that Black Hat will make

If I remember correctly, he ordered Aku to keep Jack in the future, which was a very "Simple" task according to Black Hat, but Aku couldn't do it. That's why he erased Aku from history. So if Black Hat erase someone, the erased person will need High-Godly Regen to get rid of it

I see it is possible he can use EE in the fight but he needs to be angry which would be happen mid fight or smth. I'm leaning towards incon cuz Ben can use BFR via Clockwork if he doesn't start with EE , if Black hat starts with EE he wins.

I don't know if Black Hat necessarily needs to be angry, but even Benjamin saying "It's Hero Time" might be enough, because Black Hat hates heroic things to the last degree

Besides, he literally reduced Flug to "nothingness"

Not really.
He only used it once against Aku, but never again, and he has faces against a lot of characters weaker and stronger than Aku, so he doesn't start with that definitely.

That's different.
Ben'd never use EE, but a standard move for the dual personalities is EEd someone or something.

So, BH not having the advantage of having two other weirdos that want to erase everything, would mresulr in not using EE as first move.

They used it offscreen (retcons) also their win method is EE explained in Celestialsapien's profile, They don't generally fight because They don't care about them but SBA makes them go for win so they will start with EE the SBA thing is also explained in Albedo's profile

It's hard to say, i believe in EE is in his character but not quite sure he would start with it also Ben doesn't say always it is hero time

Even if he does say it, that's not enough reason to made BH start with EE, since he hasn't use it against other characters more powerful tan Aku or more heroic than the heroes he examinated.

Although, Ben is more heroic than practically everyone on CN, but that doesn't mean he'd be EE

Bellicus and Serena, as well as other CS, stated that they would disappear someone if they wanted, like against Paradox.

Anyways, I don't care about Alien X first move now, but we do agree that BH wouldn't start with EE, so that makes Ben have a chance
