This fight was inevitable. The moment Harvey's page existed. It had to happen. It works to well.

Phoenix was defending his client against Harvey Birdman. Both debated through the day, but in the end, The Judge took Phoenixs side. Marking another loss for Harvey. This left him angered. This case could have promoted him. In a fit of rage, outside the courthouse, Harvey attacks Phoenix

Birdman has to point and shoot. Almost about the same. Maybe a bit slower cause the energy shooting part has to glow on his hand first. It's a small difference. But one none the less

And he does have a bit of skill. But take it as just a bit. He has used it on accident before without realizing, And is considered a third rate level 1 superhero (level 1 being the worst) cause he isn't exactly the best. And he is a retired hero. So he is very rusty too. He actually fought like once in the series he has.
 
Oh then Phoenix points. He's smart enough to know to use his soul and wind hax to literally blow Harvey away, a man whose literally coming to attack him. Plus Phoenix just beat him and can use his emotions against him if need be.
