Weird CM Type 3 vs CM Type 1

A character who uses Type 3 CM to kill another character who can resist Type 1 CM.

2 questions here.

Does this make hax that was "Type 3 CM" Type 1 instead

Or

is this a special case where Type 3 can bypass Type 1 CM resistance?
