Is this passive law hax?

Is it considered a "passive" if a character's Subconscious is using abilities?

Let me give an example...

A character is sub-consciously controlling the laws of death through a universe. Even while in an inactive state (Unconscious) Their consciousness is still mainting the balance of the Universe by moving dead souls into an afterlife.

Even while being knocked (Unconscious) out cold with a heavy punch the character is still maintaining the balance of the universe through his law hax. The ability doesn't end, but it is directly stated that he is doing this through an involuntary reaction on a subconscious level

Does this make it passive law hax?

So basically hes actively altering the universe unconsciously, however its via involuntary reaction, like his literal sub-consciousness just wants to do it? If so I would say its passive as long as there isn't any implication that he can overpower his subconsciousness or that this subconsciousness isn't dependent on a temporary aspect of the guy, like his state of mind or sum shit

to better add to this. Dudes been straight up killed before and his ability still remains. Hes been asleep before for centuries but his ability to help maintain balance in the universe still remains. dunno if this changes anything.
 
Yeah sounds passive to me, if you die your subconscious is supposed to be gone with you too, at least in a conventional way, so If the ability remains, it should be passive

out of curiosity, how would different types of regen affect this? Say if a different character (but same example used above) had Mid or High Godly regen?
 
I think they subconscious is never dead since will come back, usually characters are not affected by the fact they just died when they regen fast

if they had a subconscious left it wouldn't be mid or high godly regen it would be low godly, no?
 
A couscinesss is their mind though, is not always restricted to the brain
From what i understand


Mid Godly regen is the intangible mind is destroyed (some other metaphysical mind that isn't conceptual in nature) along with soul and body

and High Godly is where all of it is destroyed on a conceptual level
