Horus wins.
See, Sans may cause tons of damage to Horus with the KR, and the Warmaster would underestimate Sans, but once he gets hit, he will stop underestimating him, and via Warp shenanigans, I believe (Not sure though) he may be able to shield some/most of the damage to his soul. With that on mind, Horus simply proceeds to use a mental attack to literally explode Sans's mind, and it is game over.
Horus, high difficulty, I think.

Eh, Sans isn't a normal skeleton, and he does seems to have a mind. But even if he didn't, Horus can still attack his soul.

You mean actual brain or just a mind in general? Your wording makes it seems like you're refering to the brain. Sans definitively do not possess a brain but do possess a mind I guess.

I don't know much about Sans but although on Horus' profile it mentions that he is resistant to Soul attacks, he did in fact get his soul destroyed by the Emperor (Even though it was being "protected" by the chaos gods) which leads me to ask if Sans has the capability of being able to match the damage he took? if so he could destroy him.

There's not much Sans could do to Horus. Even assuming he gets past Horus's absurd defenses, and survives the absolute onslaught of psychic powers and physical blows, Horus's soul was only, finally destroyed by the Emperor Himself, a being of near-absolute power by Warhammer standards. Bear in mind, he wounded the Emperor to such an extent that he would have died if it weren't for the Golden Throne. Horus also has the tech advantage, and a wider array of powers.
Sans on the other hand, has no real defenses, and none of his attacks could potentially kill Horus quickly enough. He would be wiped from the physical plane of existance in an instant. It's only a matter of time before he's shattered by Worldbreaker, incinerated by plasma, or mentally obliterated by the power of Chaos.
