This is Dio, not DIO. So not part 3.
While Dio is stronger, Dracula has more abilities, and they’re both immortal.
This takes place at night (no duh). Specifically 12:00. The area has plenty of shade, so even if it does become day it wont instantly kill them both.

dio has ap advantange and range advantange. if he touches dracula he's dead and dio can mindhax better than he can.

dracula also isnt really going to do much damage to dio.
