Would be Type 5 if being beyond death grants you a type of immortality
5: Deathless Immortality: Characters who exist unbound by conventional life or death, or do not exist at all, and thus cannot be traditionally killed. Typically, abilities such as Existence Erasure are needed to destroy them.

These situations are usually type 5, I agree. But, context still matters. An undead or certain vampires for example are also beyond death in the sense that they've already crossed that line. And often gain some abilities or resistances to powers that cause death because of it.
